1About These Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Legacy Digital Vault, a division of Onavani Inc. ("Company," "we," "us," or "our"), a business operating in Austin, Texas.

These Terms govern your use of our website at https://legacyvaultdigital.com and all preservation and media management services we provide. By engaging our services — whether online, by phone, or in person — you agree to these Terms in full.

2Services Offered

Legacy Digital Vault provides professional legacy preservation including:

All services are performed locally within the Austin, TX metropolitan area. We reserve the right to decline any project outside our technical capabilities or service area.

All prices are in U.S. dollars and subject to change. The price quoted at booking is the price you pay — we do not apply retroactive increases to confirmed orders.

Collections exceeding package limits will be quoted at a disclosed per-item rate before work begins. You will always have the opportunity to approve any overage before we proceed.

4Booking, Payment & Cancellation

Booking

Services are confirmed upon receipt of a signed service agreement and any required deposit. A complimentary consultation (phone or in-person) precedes all engagements and carries no obligation to book.

Cancellation by Legacy Digital Vault

We reserve the right to cancel any project due to circumstances outside our control (equipment failure, safety concerns, force majeure). In such cases, a full refund of any deposits paid will be issued within 5 business days.

5Media Handling & Your Originals

We handle your family's irreplaceable media with the utmost care. Every item is inventoried, handled individually, and returned to you. Your originals never leave Austin.

Inventory & Chain of Custody

At collection, we create a detailed written inventory of all items received, which you sign and retain a copy of. This serves as the official record of what was entrusted to us.

Handling Standards

Return of Originals

All original physical media is returned to you at project handover in the same or better condition than received. If any item is damaged while in our possession, we will notify you immediately and determine appropriate remedy.

Pre-Existing Damage

Any pre-existing damage or deterioration noted at intake will be documented. Legacy Digital Vault is not responsible for damage that existed prior to our receiving the items, or for quality limitations caused by pre-existing physical deterioration of the media.

6Client Responsibilities

By engaging our services, you represent and warrant that:

Storage Notice: Completed projects not collected within 30 days of notification may be subject to a storage fee of $10/week. Projects uncollected after 90 days will be considered abandoned and physical media may be disposed of after further written notice.

7Delivery & Turnaround

Quoted turnaround times are estimates based on standard collection sizes and current workload. They are not guaranteed deadlines unless explicitly stated in a written agreement.

We will proactively communicate if any factor is likely to affect the timeline. If a delay extends the original estimate by more than 5 business days, we will notify you within 24 hours.

8Quality Guarantee

If you are not satisfied with the quality of any preserved item, notify us within 14 days of delivery. We will re-process the item at no additional charge, provided the issue is not caused by pre-existing damage to the original media.

Where source material is severely deteriorated, we will notify you before and during the project so you can make an informed decision.

9Limitation of Liability

Please read carefully. This section limits our legal liability in the event of loss or damage to your media while in our care.

In the event of loss or damage to original media while in our possession, our maximum liability is limited to the total fees paid for the specific service order in which the loss occurred.

Legacy Digital Vault shall not be liable for any consequential, incidental, indirect, special, or punitive damages — including damages arising from sentimental or emotional value, loss of unique historical content, or any other intangible loss.

We strongly recommend retaining possession of truly irreplaceable items where possible, or discussing enhanced handling protocols with us before entrusting extremely fragile or one-of-a-kind media.

Nothing in these Terms limits our liability for gross negligence or willful misconduct.

10Intellectual Property

Your Content

You retain full ownership of all media submitted and all digital files created from your media. We claim no ownership, license, or right to use your family's photographs or films for any purpose.

Portfolio Use

We will never use your media for marketing, portfolio, or promotional purposes without your explicit, separate, written consent. Any such consent is entirely voluntary and will not affect the terms or quality of your vault.

Our Website & Materials

All original content on our website — text, design, and branding — is the property of Legacy Digital Vault, a division of Onavani Inc., and may not be reproduced without written permission.

11Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to our Privacy Policy.

12Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Travis County, Texas, and you consent to the exclusive jurisdiction of such courts.

Before pursuing formal legal action, both parties agree to attempt resolution through good-faith negotiation or mediation. Please contact us first — most concerns can be resolved directly and quickly.

13Changes to These Terms

We reserve the right to update these Terms at any time. Changes will not apply retroactively to confirmed orders — the Terms in effect at the time of booking govern that engagement.

Your continued use of our website or services after any changes constitutes acceptance of the updated Terms.
